How to file a mechanics lien in Arizona
Unpaid for work or materials on an Arizona construction project? Completion and preliminary notices need separate checks. Use this guide to organize the filing questions, then check the cited law against your role and project.
AZ · PRIVATE CONSTRUCTION CLAIMS
Completion and preliminary notices need separate checks.
Section 33-993 uses 120 days after statutory completion, shortened to 60 days after a recorded notice of completion. The statute defines completion; it is not simply the invoice date.
Notices to check before filing
The notice and claim includes the preliminary 20-day notice and the required evidence of service. Check whether and how that notice requirement applies to you.
Where and how to file in Arizona
Record the sworn notice and claim with the county recorder where the property is located and serve the owner within a reasonable time after recording.
A filing mistake to avoid
Sending a payment reminder does not replace a statutory preliminary notice.
Prepare your project records
Gather the contract, legal property description, balance after credits, completion evidence, preliminary notice, and service records.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.
