AR · PRIVATE CONSTRUCTION CLAIMS
The filing package needs notice evidence, not just an invoice.
Section 18-44-117 requires filing within 120 days after the covered items were furnished or work was performed.
Notices to check before filing
Attach an affidavit addressing applicable notice provisions in Sections 18-44-114–116, copies of the required notices, and the required service proof.
Where and how to file in Arkansas
File with the circuit court clerk in the county containing the improvement. The account and property description must be verified.
A filing mistake to avoid
The statute expressly says a street address alone is not a sufficient real-property description. Missing affidavits and attachments can prevent filing.
Prepare your project records
Obtain the property’s legal description, an account allowing all credits, notice copies, and delivery evidence.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.
