How to file a mechanics lien in Indiana
Unpaid for work or materials on an Indiana construction project? The structure classification changes the recording period. Use this guide to organize the filing questions, then check the cited law against your role and project.
IN · PRIVATE CONSTRUCTION CLAIMS
The structure classification changes the recording period.
Section 32-28-3-3 generally uses 90 days after labor or materials, but work related to a Class 2 structure or an auxiliary improvement has a 60-day period.
Notices to check before filing
The filing is a sworn statement and notice of intention to hold a lien. Earlier notice requirements must be checked separately for the project.
Where and how to file in Indiana
File duplicate copies in the county recorder’s office. The statement includes the owner’s address from county tax records and the property description.
A filing mistake to avoid
Do not assume the general 90-day rule applies to a residential project without checking the statutory structure classification.
Prepare your project records
Collect the legal description, property-tax owner address, claimant details, amount, and dates of labor or delivery.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.

The Credit App offers administrative mechanics lien preparation and a recording attempt for $249. Confirm your state, project, notices, and timing before ordering. The service uses the information you provide; it does not determine legal sufficiency, verify ownership, or represent you in an enforcement action.
