How to file a mechanics lien in Kansas
Unpaid for work or materials on a Kansas construction project? The direct-contractor and subcontractor rules differ. Use this guide to organize the filing questions, then check the cited law against your role and project.
KS · PRIVATE CONSTRUCTION CLAIMS
The direct-contractor and subcontractor rules differ.
Section 60-1102 generally gives a claimant under §60-1101 four months after last furnishing or labor. A qualifying nonresidential extension requires a timely notice; it is not automatic.
Notices to check before filing
Subcontractors must also review §60-1103 rather than borrowing the direct-contract rule. Identify residential status and any required notices.
Where and how to file in Kansas
File a verified statement with the district court clerk in the property’s county, including the property, parties, and itemized amount.
A filing mistake to avoid
The possible five-month nonresidential period depends on filing and mailing an extension notice within the statutory time.
Prepare your project records
Gather the contract chain, last furnishing date, property description, itemized balance, and any extension notice and mailing records.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.
