How to file a mechanics lien in Kentucky
Unpaid for work or materials on a Kentucky construction project? Recording the statement does not replace mailing the owner. Use this guide to organize the filing questions, then check the cited law against your role and project.
KY · PRIVATE CONSTRUCTION CLAIMS
Recording the statement does not replace mailing the owner.
Section 376.080 requires the lien statement within six months after ceasing to labor or furnish materials. Earlier notice obligations under §376.010 must also be checked.
Notices to check before filing
Mail a copy of the statement to the property owner at the last known address within seven days after filing.
Where and how to file in Kentucky
File the sworn statement with the county clerk where the improvement is situated. Include the amount after credits, property description, and contracting relationship.
A filing mistake to avoid
The statute provides for dissolution if the owner copy is not sent as required. Do not treat the recording receipt as the final task.
Prepare your project records
Prepare the claimant’s service address, owner information, contract chain, verified amount, and evidence of timely mailing.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.
