How to file a mechanics lien in Mississippi
Unpaid for work or materials on a Mississippi construction project? Required expiration and contest notices belong in the claim. Use this guide to organize the filing questions, then check the cited law against your role and project.
MS · PRIVATE CONSTRUCTION CLAIMS
Required expiration and contest notices belong in the claim.
Section 85-7-405 generally requires recording within 90 days after the claimant’s last covered work, services, or materials.
Notices to check before filing
The claim must include the statutory expiration statement and notice that the owner can contest the lien. The statute says omission invalidates the lien.
Where and how to file in Mississippi
Record with the chancery court clerk in the property’s county and check the delivery and payment-action provisions that follow.
A filing mistake to avoid
A generic lien form can omit required Mississippi language even when the property and amount are correct.
Prepare your project records
Keep contract-performance evidence, the last furnishing date, the complete filed claim, and all notices or contest papers.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.
