How to file a mechanics lien in Nebraska
Unpaid for work or materials on a Nebraska construction project? Recording and enforcing the lien use different clocks. Use this guide to organize the filing questions, then check the cited law against your role and project.
NE · PRIVATE CONSTRUCTION CLAIMS
Recording and enforcing the lien use different clocks.
Section 52-137 generally requires recording no later than 120 days after final furnishing of services or materials.
Notices to check before filing
Review project notices and priority before recording. Section 52-140 separately governs enforcement and provides a procedure through which an interested person can demand action.
Where and how to file in Nebraska
Prepare the construction-lien recording under the Nebraska Construction Lien Act; check the property records and notice-of-commencement history.
A filing mistake to avoid
Do not assume the ordinary enforcement period cannot be shortened by a statutory demand.
Prepare your project records
Collect final furnishing evidence, the contract balance, property description, commencement notice, and any demand to enforce.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.
