How to file a mechanics lien in New Jersey
Unpaid for work or materials on a New Jersey construction project? Residential construction adds a notice and arbitration process. Use this guide to organize the filing questions, then check the cited law against your role and project.
NJ · PRIVATE CONSTRUCTION CLAIMS
Residential construction adds a notice and arbitration process.
For a residential construction contract, §2A:44A-21 requires lodging the Notice of Unpaid Balance and Right to File Lien within 60 days after the last covered contribution.
Notices to check before filing
Unless a permitted alternative is agreed in writing, the claimant must serve an arbitration demand within ten days after lodging that notice and follow the expedited process.
Where and how to file in New Jersey
The residential notice is a condition before the lien claim. Review the separate lien-filing deadlines and the arbitration determination; do not apply a commercial checklist.
A filing mistake to avoid
A Notice of Unpaid Balance is not the final construction lien, and starting arbitration does not remove the filing requirements.
Prepare your project records
Keep the residential contract, notice and service evidence, arbitration demand, determination, and last furnishing dates.
- Identify who hired you and whether the property is privately owned.
- Confirm your notice obligations and the event that starts each time limit.
- Verify the owner and property description using appropriate records.
- Reconcile invoices, payments, credits, and disputed amounts.
- Keep filing and service receipts, and calendar any enforcement deadline.
After the claim is filed
Filing does not guarantee payment or establish that a disputed claim is valid. Preserve the filed document and delivery evidence. If payment arrives, arrange the required release or satisfaction. If the balance remains unpaid, seek advice about enforcement before its separate deadline expires.
Help with your unpaid construction account
This state includes a court, attachment, or arbitration step that may require legal assistance. Ask support to confirm what administrative help is available before buying a lien service. Court representation and legal advice are outside The Credit App’s administrative recording service.
